CONTEST RULES

(the “Official Rules”)

(the “Contest”)

 

 

These Official Rules govern the Contest.  By participating or attempting to participate in the Contest, you will be deemed to have received, understood, and agreed to these Official Rules.

 

  1. WHO are the Sponsors?

 

The Contest is sponsored and administered by Rogers Communications Inc. or one of its subsidiaries or their affiliates (“Rogers”), on behalf of radio station 106.1 CHEZ (the “Station”).

 

The following entities are co-sponsors of the Contest: Guildcrest Homes, Import Car Centre, Ottawa Fastner Supply, Fitness Depot, Cash for Trash, Rideau Carleton Casino, Ottawa Senators, RBC Bluesfest, Cabelas, Overflow Brewing Company, together with Rogers, collectively the “Sponsors”.

 

Although the Contest may be communicated, promoted, or administered by means of a third party social media or social networking service or site (a “Third Party Service”), the Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Service; any questions, comments or complaints regarding the Contest should be directed to Rogers and not to any Third Party Service.

 

  1. WHO MAY ENTER THE CONTEST?

 

 

The following individuals are not eligible to enter the Contest:

  • employees, officers, directors, agents, and representatives of: (i) the Sponsors, or any of their respective parents, subsidiaries or affiliates; (ii) any prize suppliers; (iii) any and all other companies associated with the Contest;
  • a household member of any of the individuals listed in (a), above, whether or not related; and
  • members of the immediate family (spouse, parent, child, sibling) of the individuals listed in (a), above.

 

Entries received online shall be deemed to be submitted by the individual assigned to the e-mail address, telephone number, Instagram Account or Facebook Account associated with the Contest entry. For the purpose of these Rules, an authorized account holder of any of the above is defined as the person who is assigned to any of the above by an internet access or telephone provider, online service provider, Facebook or Instagram or any other organization responsible for assigning an individual to an email address, telephone number, Facebook or Instagram account associated with the submitted entry. A Qualifier (as further defined below) may be required to provide proof that he/she is the authorized account holder associated with the selected entry.

 

  1. WHEN DOES the contest START/END?

 

You may enter the Contest between 12:01 a.m. Eastern Time (“ET”) on Monday, March 4, 2019 and 1:45 p.m. ET on Friday, May 4, 2019 (the “Entry Period”).

 

  1. how do I enter the contest?

 

No purchase is necessary to enter the Contest. Enter using one of the following six (5) methods:

 

  • listen to the Station weekdays (Monday-Friday only) between 6:00 a.m. and 7:00 p.m. ET during the Entry Period for a cue to text within five (5) minutes of any such cue to text, (the “Entry Window”), send the Station a single message that starts with the keyword TOYS to 762555. Such message may be sent via a cellular telephone that is capable of two-way messaging. Your carrier’s standard text message or short code message and data rates may apply. By sending a message to the Station in accordance with these Official Rules, you agree to having any phone call with the radio station recorded and played on-air by the Station.

 

Following the close of each Entry Window, the Station will conduct a random draw in Ottawa, ON from among all eligible messages received during such Entry Window (the “Eligible Messages”), to select one (1) entrant as a potential qualifier. Non-selected messages will not carry forward to the next Entry Window. The Station will contact each selected entrant using the phone number used to send the text entry. In the event the Station is unable to make contact with a selected entrant for any reason within 24 hours, the Station may disqualify a selected entrant and randomly select an alternate entrant from among an Entry Window’s remaining Eligible Messages until the Station successfully makes contact with an eligible entrant.

 

Notwithstanding the above, in the event of any technical issues relating to the Station’s messaging platform (as determined by Rogers), a cue to text may be altered to a cue to call, such that the Station would prompt its listeners to call the Station (613-750-1061), and the 15th eligible caller would be selected as a potential qualifier. In the event of any such cue to call, the following terms and conditions apply:

 

If the telephone line is dead when answered, no audible response is heard, or no one responds after five seconds, the Station will answer the next call in sequence. In the event a call is cut off before all personal data is collected, the Station will use reasonable efforts to make contact with the cut-off caller, provided enough personal information was gathered in order to correctly identify the cut-off caller. In the event two or more calls come through on the same line, all such callers will be advised to hang up and try again, and the next call in sequence will replace that call. In the event the Station answers a call and identifies the caller as an individual already qualified in this Contest or ineligible to participate in this Contest, the Station will answer the next call in sequence.

 

The Station’s online stream may be a delayed stream of the Station’s radio signal and may vary depending on your computer’s memory capacity and the speed of your Internet connection. For that reason, it is recommended that listeners listen to the Station in “real time” by turning in on an actual radio.

 

A total of one hundred and eighteen (118) Contest qualifiers (the “Qualifiers”) that entered through this entry method will receive keys (the “Keys”) for the Grand Prize draw May 14th 2019.

 

  • Weekly draws (“Weekly Draws”) will begin Monday, March 4, 2019 at 6:00 a.m. ET. Register for or log into your Rock Empire account on 1061chez.ca/ to enter the draw. You may enter each Weekly Draw once per hour. Beginning on Monday, March 4, 2019 at approximately 9:00 a.m. ET and each Monday thereafter until April 28, 2019 (each a “Draw Date”), a Rogers representative will select one entrant as a potential Qualifier from all eligible entries received as of each Draw Date.

 

A total number of eight (8) Qualifiers that entered through this entry method will receive Keys for the Grand Prize draw.

 

  • During the Entry Period, there will be Live Show Broadcasts on the dates below, the details of which will be posted at 1061chez.ca/contests in the Contest information posting. At each such Live Show Broadcast, individuals will have the opportunity to complete and submit a ballot on site.  Two (2) Qualifiers will be drawn at random by a Station representative from the eligible ballots received at each Live Show Broadcast and will receive Keys for the Grand Prize draw. One (1) additional Qualifier will be selected randomly from among all qualifying photos taken in the photo booth on site at each location and posted to Instagram. To qualify, a potential Qualifier must tag 1061 Chez, Guildcrest Homes and one additional contest sponsor in the photo. To qualify, the photo must also be posted using the #contest hashtag. One entry per person per location.

 

Qualification Entry Limit: One ballot and one photo per person per Live Show Broadcast.  Broadcast dates are as follows:

  • Fri March 15 from 3:00pm-7:00pm @ Overflow Brewing Co. (2477 Kaladar Ave)
  • Sat March 16 from 2:00pm-6:00pm @ Rideau Carleton Casino – Future Home of Hard Rock (4837 Albion Road)
  • Friday March 22 from 3:00pm-7:00pm @ Cabelas (3065 Palladium Dr)
  • Friday April 12 from 3:00pm-7:00pm @ Import Car Centre (880 Merivale Rd)
  • Thurs April 18 from 3:00pm-7:00pm @ Cash For Trash (7628 Flewellyn Rd)
  • Fri April 26 from 1:30pm-5:30pm @ Tool and Equipment Store (2205 Robertson Rd) *one key only*
  • Sat April 27 from 10:00am-2:00pm @ Tool and Equipment Store (3020 Hawthorne Rd) *one key only*
  • Thurs May 2 from 3:00pm-7:00pm @ Import Car Centre (880 Merivale Rd)
  • Fri May 3 from 3:00pm-7:00pm @ Fitness Depot (499 Industrial Ave)
  • Sat May 4 from 9:00am-3:00pm @ Guildcrest Homes Morewood (20 Mill Street)

 

Two (2) Qualifiers from each of the above remote locations will be selected. A total number of twenty (21) Qualifiers that entered through this entry method will receive Keys for the Grand Prize draw.

 

  • Comment Contest-Visit the 106.1 CHEZ Facebook page and ‘Follow’. Each Thursday morning look for the TOYS 20 prize photo and question and comment on them. A random draw from all eligible entries received via this mechanism will be drawn by a representative of the station on each subsequent Friday starting March 7th and ending on April 25th, by 9:00am in Ottawa, Ontario. One (1) individual will be selected each week, for a total of eight (8), as Contest Qualifiers. The selected individuals will be contacted via Facebook Direct Message. The Selected individuals will be disqualified and required to forfeit any claim to the Contest prize if he or she cannot be reached within one (1) business day following the first attempt of contact or if the terms set forth in these Contest rules are not adhered to.

 

Qualification Entry Limit: One comment per person/Facebook account per week. A total number of eight (8) Qualifiers that entered through this entry method will receive Keys for the Grand Prize draw.

 

  • Download the 106.1 CHEZ APP and enable push notifications. There will be eight (8) call in to win chances between March 4, 2018 at 6am and April 26th at 6pm. Each week we will send out a push notification that will reveal the exact date and time to call the Station at (613-750-1061), as instructed by the Push Notification. To be deemed a Qualifier, you must be 15th caller to reach the Station following any such cue to call.

  1. How many times may i ENTER THE CONTEST?

 

You may enter the Contest in accordance with the directions set out in section 4 above. There can only be one (1) Qualifier per household.

 

  1. COULD MY ENTRY BE REFUSED OR REJECTED?

 

Your entry could be refused or rejected if:

  • you attempt to enter the Contest in a fashion not authorized by these Official Rules;
  • your entry contains false or misleading information, or is late, falsified, illegible, damaged or incomplete or otherwise irregular;
  • your entry is submitted using robotic, automated, programmed, or other illicit means; or
  • your entry is not in compliance with these Official Rules.

 

In addition, the Sponsors reserve the right to refuse any entry for any other reason as they may determine.

 

  1. WHAT ARE THE CONDITIONS OF ENTRY?

 

By entering the Contest:

  • you agree to be bound by these Official Rules and by the decisions of the Sponsors, which decisions are final, binding and conclusive;
  • you represent and warrant that (i) your entry, including any material comprising your entry (e.g. name, user name, profile picture, etc., as applicable) and any material submitted with your entry (e.g. photograph, video, written submission, or other form of submission, as applicable) (all such material, collectively, the “Entry Material”) is original to you, (ii) you have all necessary rights in and to your Entry Material to enter the Contest, including the consent of any third parties whose personal information is included in your Entry Material, and (iii) your Entry Material does not contain, depict, include or involve content that is, or could reasonably be considered to be, inappropriate, unsuitable or offensive, as determined by the Sponsors;
  • you understand and agree that your entry, including your Entry Material, will not be returned to you and may be moderated or edited by Rogers as it deems appropriate;
  • you grant to the Sponsors the irrevocable right to use your Entry Material in any media worldwide and for any purpose related to the Contest (or any similar contest), including the right to use, reproduce, modify, adapt, translate, or create derivative works from, your Entry Material without notification, compensation or additional consideration to you;
  • you waive all claims of moral rights in any use of your Entry Material by Rogers pursuant to the rights granted in these Official Rules;
  • you agree that the Sponsors shall have the right at any time to require proof of identity or eligibility to enter the Contest; failure to provide any such proof upon request may result in disqualification;
  • you release and forever discharge the Sponsors, their respective parents, affiliates, and subsidiaries, any other companies associated with the Contest, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns, as well as any Third Party Services, (collectively, the “Releasees”), and agree to indemnify and hold harmless each of the Releasees, from and against any and all claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, arising out of, or in any way related to, (i) your participation in the Contest, (ii) the awarding, receipt, possession, use or misuse of any prize, in whole or in part, or any travel or activity related to any prize, (iii) the use of any Entry Material or Publicity Material (defined below) in accordance with the rights granted in these Official Rules, or (iv) any breach of these Official Rules.

 

  1. WHAT ARE THE CONTEST PRIZES?

 

There is one (1) prize consisting of a Toys20 package (the “Grand Prize”) available. The Grand Prize has an approximate value of two-hundred and twenty-one thousand Canadian Dollars (CAD $221,000.00). In lieu of accepting the Cottage, the Winner may select a cash prize of $50,000 CAD.

The Grand Prize package includes:

 

  • One (1) Pre-Fabricated Single Modular Cottage in the Champlain Model (the “Model”) from Guildcrest Homes (the “Cottage”). Retail value of the Cottage is $136,804.00 CAD plus HST. Value of the Cottage is not redeemable for cash. In lieu of the Cottage, the Winner may select a cash prize alternative of $50,000 CAD (the “Cash Prize”).

 

Cottage Description: The Cottage is 809 square feet and includes two (2) bedrooms, one (1) bath, a country style kitchen, transom windows and a covered porch. Guildcrest reserves the right to substitute cottage model at their sole discretion. The Grand Prize package includes the Cottage only. The Winner is responsible for providing the land necessary to accommodate the Cottage (the “Designated Land”).

 

Responsibilities of Winner: Winner is responsible for providing the following items including, but not limited to, a foundation built to the dimensions supplied by Guildcrest, c/w R-22 wall insulation, purchasing and installing a natural gas or propane forced air furnace with a minimum AFUE of 96%, purchasing and installing a natural gas or propane hot water heater with a minimum Energy Factor (EF) of 0.67, completing any necessary ductwork, completing the electrical, plumbing and ventilation systems, eaves trough, all exterior steps and deck, drain water heat recovery unit, all permits and site work (excavation, backfill, driveway, well & septic), all site engineering (if applicable).

 

Final Acceptance Date: The Winner must confirm acceptance of the Cottage with Guildcrest Homes, verify location for delivery and place an order for the Cottage through Guildcrest Homes by June 15, 2019 (the “Final Acceptance Date”). Once the Cottage has been accepted, the Winner is deemed to have forfeited the Cash Prize.

 

Final Delivery Date: Delivery of the Cottage must take place before November 1, 2019 (the “Final Delivery Date”). If the Winner does not accept the Cottage by the Final Delivery Date, for any reason, the Winner is deemed to have forfeited the Cottage. Guildcrest Homes is not responsible for adjusting the Final Delivery Date to accommodate delays of any nature. For clarity, failure to accept the Cottage by the Final Delivery Date does not constitute eligibility for the Cash Prize.

 

Permission of Titleholder: The Winner represents and warrants that they have good title to the Designated Land or has obtained the necessary lease, licenses and/or other permissions from titleholder of the Designated Land to accommodate the Cottage on the Designated Land. The Sponsors assume no responsibility for removing and/or relocating the Cottage from the Designated Land once it has been delivered under instruction of the Winner. Any removal and/or relocation of the Cottage must be undertaken at the Winner’s expense.

 

Required Permits and Licenses: It is the Winner’s sole responsibility to obtain all permits and/or licenses, toll fees and / or police escorts required by the municipality and/or province to accommodate and set up the Cottage on the Designated Property.

 

Delivery of Cottage by Guildcrest Homes: Guildcrest Homes will deliver the Cottage to the Designated Land only if it is located within 100 kilometers of The Guildcrest Homes sales site located at 20 Milwood Street, Morewood Ontario. Guildcrest Homes can refuse delivery of the Cottage to the Designated land, at its sole discretion, if it deems the Designated Land unsuitable, for any reason, to execute the delivery. The Winner is responsible for any ancillary costs incurred by Guildcrest Homes in the course of delivering the Cottage, including any toll fees, police escorts or permits. Delivery to any location beyond 100 kilometers of the address above is not included in the Grand Prize and must be coordinated by and executed at the Winner’s expense. Guildcrest Homes does not provide delivery outside of Canada.

 

Prior to Delivery: The Winner must clear all access needs to the Designated Property with Guildcrest Building Corporation. The Winner must supply, at their expense, a crane to the Designated Property to move the Cottage as well as obtain any permits required by the municipality and/or province to use the crane on the Designated Property. The Winner must have a foundation, crawl space or piers prepared and ready for the purposes of accepting and stabilizing the Cottage upon delivery. Foundation, crawl space or piers must be inspected by a certified engineer prior to delivery date.

  • One (1) Used 2017 Lexus NX 200T with Premium Package (the “Vehicle”) starting with 24,750 kilometers from Import Car Centre. The Vehicle must be insured by the Winner prior to prize fulfillment. Retail value of $38,450.00 CAD.

 

  • One (1) Milwaukee Tool Package and Husqvarna Power Equipment Package from the Tool & Equipment Store. Retail value of $7,221.00 CAD.

 

  • One (1) 2019 Suzuki Kingquad LT-A400F 5-speed from Cash for Trash. Retail value of $7,300.00 CAD.

 

  • One (1) VIP Prize Pack from the Rideau Carleton Casino. Retail value of  $10,000 CAD.

 

  • One (1) Patio Furniture Package by Kingston Casual from Fitness Depot. The Madison Modular collection is wicker woven and includes a sectional couch, two club chairs, love seat, coffee table and cantilevered Treasure Garden giant umbrella. Value of $8,000.00 CAD.
  • One (1) pair of 100 Level Season Tickets including Parking from the Ottawa Senators. Value of $8,000.00 CAD.
  • One (1) Outdoors Prize Package from Cabelas including, 24” Wood Elliptical Pellet Grill, Wood Pellets, 2 Ascend D10 Sit-In Kayaks, 2 Yukon Base Paddle Vests, Five Piece Cast Iron Set, 100QT Polar Cap Equalizer Cooler, Landmann Big Sky Super Sky Fire Pit, 2 Carlisle Magic Mystic Aluminum Kayak Paddles, Intex Splash and Chill Island, Intex Inflatable, Firman Whisper Series 1700 Watt Inverto Generator, and $500 Gift Card. are there any prize conditions?

 

In addition to any Prize conditions provided elsewhere in these Official Rules, any Prize awarded in the Contest is subject to the following conditions:

  • Prize value in these Official Rules is approximate only.  You will not be compensated if actual Prize value is lower than the value quoted in these Official Rules.
  • The Prize may be substituted, in whole or in part, with a prize or prize component of equal or greater value if the Prize or Prize component cannot be awarded for any reason.
  • The Prize must be accepted as awarded and may not be transferred, unless otherwise determined by the Sponsors. The Prize may not be exactly as advertised.  The Prize is provided “as is” without representation or warranty of any kind by the Sponsors.
  • The Prize may not be resold.
  • Any unused portion of the Prize, once awarded, will be deemed forfeited.  The Prize will not be replaced if lost, destroyed, mutilated or stolen.

 

  1. how will the potential winner(s) be selected?

 

All Qualifiers will be invited to participate in an event to be held at the Overflow Brewing Company on May 14, 2019 at a time to be determined (the “Event”). Approximately one hundred and sixty four (164)  Qualifiers will be selected in total during the Contest Period.

 

All Qualifiers (or their designated proxies) must be in attendance at the Event in order to be eligible to win the Prize. All Qualifiers will be required to register with Contest officials upon arrival at the Event, by a specified time to be determined on your invitation or by phone. Failure to officially register at the Event by the pre-determined time may result in disqualification from the Contest.

 

Any Qualifier who cannot attend the Event must notify Contest officials in advance, in writing, with the name of their designated proxy who will participate on their behalf.  Failure to notify Contest officials by the pre-determined time will result in disqualification from the Contest. Deadline for proxy notification is May 8th, 2019.

 

At the Event, a number of labeled CD’s, equal to the number of Qualifiers in attendance will be placed on display.  One (1) of these CD’s representing the winning Key will unlock the Prize.

 

Upon registration, each Qualifier will select a number to determine the order in which the CD’s will be drawn.  In pre-determined order, each Qualifier will then form a line as per the Contest official’s instructions then one (1) at a time the Qualifier will select a CD from the display and test it in the provided CD player.

 

The first Qualifier who has drawn the CD that plays the Prize Winner Message will be deemed the selected Prize Winner. In order to win, the selected entrant must first have correctly answered, unaided, a time limited, mathematical skill testing question posed at the Event. The selected entrant will be required to sign a release and waiver form before being declared the Winner. 106.1 CHEZ judges’ rulings are final and without appeal in all matters related to the Contest and the awarding of the Prize.

 

In the event a Qualifier is NOT present or leaves the Event early, or is nowhere to be found, when their number is called, the officials have the right to disqualify that Qualifier and pull a CD randomly from the wall and eliminate it from the Contest. If the winning CD is pulled, it will be replaced, and a different CD will be pulled.

 

  1. how can a potential winner BECOME A winner?

 

To be declared a winner, a potential winner:

  • must correctly answer, without assistance, a time-limited, mathematical skill-testing question to be administered by the Sponsors;
  • must be in compliance with these Official Rules;
  • must sign and return, within any designated time period, a release of liability and consent to publicity form and any other documentation as reasonably required;
  • may be required to provide proof of identification to confirm eligibility or to claim a prize, or provide proof that he or she is the authorized account holder of any account associated with the selected entry.

 

  1. WHAT ARE THE ODDS OF WINNING a prize?

 

The odds of being selected as a Qualifier depend on the number of eligible entries received via each method of entry. The odds of being selected as a potential Winner are one (1) in one hundred and sixty-four (164).

 

  1. how do i claim a prize?

 

Once a potential winner is confirmed as the Winner, Prize distribution will be promptly coordinated.

 

Except as otherwise indicated by the Sponsors, a winner must personally take delivery of the Prize as instructed within thirty (30) days of being notified that such Prize is available or within such other time period as may reasonably be advised.

 

If a winner fails to take delivery of the Prize as instructed, the Prize will be deemed forfeited.

 

  1. WILL I APPEAR IN ANY PUBLICITY IF I AM A WINNER?

 

If you are a winner, the Sponsors may require you to appear in publicity related to the Contest or to any similar contest.

 

By accepting a Prize:

  • you grant to the Sponsors the irrevocable right to record, photograph or otherwise capture or document you, your likeness, your voice, or any statements you make regarding the Contest or the Prize, by any available means;
  • you agree that any such captured material, together with your biographical information, such as name or place of residence, or your Entry Material (collectively, all such materials, the “Publicity Material”) may be used by the Sponsors or their licensees, successors, or assigns (collectively, the “Publicity Parties”) in any media, whether now known or later devised, worldwide and in perpetuity, for advertising or promotional purposes related to the Contest or any similar contest.  Any such use of the Publicity Material may include the reproduction, modification, adaptation, translation or creation of derivative works from your Entry Material;
  • you acknowledge that the Publicity Parties shall not be required to compensate you, notify you, or request your permission in connection with their use of any Publicity Material, unless otherwise prohibited by law; and
  • you waive any rights that you may have or that may otherwise exist in connection with any use of the Publicity Material by any of the Publicity Parties, including any moral rights in any such Publicity Material.

 

  1. HOW will MY PERSONAL INFORMATION be COLLECTED, USED AND DISCLOSED?

 

By entering the Contest, you consent to Rogers’ collection, use and disclosure of your personal information in accordance with the Privacy Policy, available at www.rogers.com/web/content/Commitment-to-Privacy (the “Rogers Privacy Policy”), for purposes of administering the Contest as described in these Official Rules.

 

Over the course of participating in the Contest, you may be given the option to receive commercial emails or other communications of a commercial nature (collectively, “Commercial Communications”) from the Sponsors or other parties.  Should you elect to receive Commercial Communications from Rogers, your personal information will be used by Rogers to that end, in accordance with the Rogers Privacy Policy.

 

Your personal information may be disclosed to a third party in the following circumstances:

  • in accordance with these Official Rules, or with your consent, or as otherwise permitted or required by law.
  • if you elect to receive Commercial Communications from a party other than Rogers, Rogers will disclose your personal information to that other party for that purpose;
  • if you are a potential Prize winner, Rogers may disclose your personal information to any Prize supplier for purposes of Prize fulfillment; and
  • if you have been asked to sign and return a release of liability and consent to publicity form or other documentation in accordance with the terms of these Official Rules, Rogers may disclose your personal information to any interested party, such as an entity who is released from liability.

 

Rogers’ disclosure of your personal information to another party will cause your personal information to be subject to that party’s privacy policy and practices.

 

  1. how DO the releasees LIMIT THEIR LIABILITY?

 

The Releasees assume no liability for the following:

  • stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, jumbled, or garbled entries, transmissions, email, mail, or other communications;
  • any error, omission, interruption, defect or delay in transmission, processing, or communication;
  • failures or malfunctions of, or difficulties with, computer hardware or software, telephones, telephone lines, telephone systems, or network, cable, satellite, server, or website connections;
  • printing, typographical, or other errors appearing within these Official Rules, in any Contest-related advertisements, or in Contest-related materials;
  • incorrect or inaccurate information, including where caused by website users, tampering, hacking, or by any equipment or programming associated or used in connection with the Contest;
  • injury or damage to any computer or other device resulting from or otherwise related to participation in the Contest, the use of any website, or the downloading or accessing of any materials;
  • anyone being incorrectly or mistakenly identified as a winner or potential winner; or
  • any other errors, problems or difficulties of any kind, whether human, mechanical, electronic, or otherwise, relating in any way to the Contest, including those errors, problems or difficulties that may relate to the administration of the Contest, the processing of entries, the advertising of the Contest, the announcement of any Prize or Prize winner, or the cancellation or postponement of any event.

 

  1. What laws apply to the contest?

 

The laws of the province or territory in which you reside apply to the Contest.

 

Any attempt to undermine the legitimate operation of the Contest may be a violation of criminal or civil laws.  Should any such attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law.

 

  1. CAN THE SPONSORS CANCEL OR AMEND THE CONTEST?

 

The Sponsors may cancel, modify, or suspend the Contest or amend these Official Rules for any reason whatsoever, subject to prior approval by the Régie des alcools, des courses et des jeux, if legally required.  For example, if for any reason the Contest is not capable of running as originally planned, the Sponsors may adjust any of the dates, timeframes or other Contest mechanics, or suspend or cancel the Contest.

 

You may not amend these Official Rules in any way.

 

  1. would the Sponsors ever DISQUALIFY or ban someone from a contest?

 

The Sponsors may disqualify without notice or ban someone from the Contest or any future contest for any other reason, including if the Sponsors find that a person has:

  • resold or attempted to resell a Prize, in whole or in part;
  • tampered with or attempted to tamper with, or undermined or attempted to undermine, the legitimate operation of the Contest;
  • provided false or misleading information;
  • acted in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any person; or
  • otherwise violated these Official Rules.

 

  1. What HAPPENS if these official rules contradict other contest materials?

 

In the event of any discrepancy or inconsistency between these Official Rules and disclosures or statements made by the Sponsors or appearing in other Contest-related materials, these Official Rules shall govern.

 

  1. What HAPPENS IF PART OF THESE OFFICIAL RULES BECOMES UNENFORCEABLE OR DOES NOT APPLY?

 

If any part of these Official Rules is legally unenforceable or inapplicable, then that part will be deemed invalid; however, the remainder of these Official Rules will otherwise continue to be legally binding.

 

  1. if i am a resident of quebec, is there any additional information i should know?

 

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
